Philippines’ Metro Rail Transit Corporation cases against government units involving the taxability of the EDSA Light Rail Transit System

C&G Law is representing Metro Rail Transit Corporation (“MRTC”) in proceedings before various courts (including the Philippine Supreme Court) against the local governments of Makati City, Pasay City, Mandaluyong City and Quezon City. The case involves the issue of whether the EDSA Light Rail Transit System which MRTC built for the Philippine government on Epifanio Delos Santos Avenue (Metropolitan Manila’s principal thoroughfare) is subject to real property taxes, and whether the various city governments validly levied on, auctioned off and forfeited the portion located within their respective boundaries in satisfaction of the alleged real property tax liability.

The outcome of this case will affect ownership and possession of the EDSA Light Right Transit System and could have significant consequences on the entire country. Moreover, these cases involve a novel question of law.
